Hinds (Allison), who was driving her car along La Seiva Road, Maraval
last month, was involved in an accident with another vehicle.
The police were called in and when Mrs. Hinds went to produce her
driver’s permit she discovered that it had expired some time
previously.
Sources say it was a slip-up for Hinds since she appeared not to
remember the date when her permit expired.
Luck was indeed not going her way, since she had to find out the
hard way that her permit had expired after an accident.
The lady attorney was charged under Section 42 of the Motor Vehicle
and Road Traffic Act 48:50 as amended by Act 25 of 1999.
Under the old law, a driver could not have been charged with driving
with an expired permit.
But police officers are arguing that a driver cannot be charged
with driving without insurance, since the driver had a permit but
it had expired. However, it is left to the magistrate to use his
or her discretion as to whether to impose a fine or reprimand and
discharge Hinds on the charge.
She faces no disqualification since the vehicle was covered by insurance,
police say.
The fine for driving can range up to $500. (A.A.)
